There have not been any updates from CMS since FHAS’ last correspondence, but we wanted to reiterate a few things:
FHAS received the following email from CMS Wednesday, 8/17, Evening:
Due to the TMA IV court order on 08/03/2023, the federal IDR portal and all IDR web forms were temporarily unavailable.
The Departments have granted disputing parties with open single and bundled disputes from 2022 a 5-business day extension to complete and submit their Notice of Offer webform. Impacted parties with single and bundled 2022 disputes where the Notice of Offer due date was 8/4/2023 to 8/18/2023 have been notified that their new Offer Due Date will be 8/23/2023 if they have not already submitted their offer.
FHAS received an excel of 18 disputes that fell under these extensions. Both parties involved in each dispute should have received a notification about this extension from CMS. FHAS did an additional reach out to these parties to ensure they know to submit their offer timely. If you were a party who was granted an extension you should have received an email from FHAS prior to this update with the Subject: CMS Granted Extensions 2022 Singles. If you did not receive this email then none of your disputes fell under the requirements for this round of extensions.
The only disputes that have received an extension so far are disputes INITIATED in 2022. There still have not been extensions granted for 2023 disputes. Another extension and due date will be given for 2023 disputes.
*CMS is doing portal maintenance that is causing FHAS to be unable to download or access the majority of files in the portal. This should be resolved by end of day – but all requests may not be doable. Thank you for understanding!
- CMS released the following statement regarding entities inability to download files that were uploaded to the portal: Please be advised, the Federal IDR Portal is experiencing an issue related to the ability for certified IDR entities to download files. Users may experience issues downloading files intermittently at this time. Certified IDR entities’ ability to view files on the Federal IDR Portal is not impacted.
Reminder of Current CMS Guidelines Related to the TMA IV Ruling
As of August 11, 2023, the Departments have directed certified IDR entities to resume processing all single and bundled disputes initiated on or before August 3, 2023. Additionally, on August 8, 2023, certified IDR entities resumed processing batched disputes where the certified IDR entity determined that the batched dispute was eligible and administrative fees have been paid (or the deadline for collecting fees expired) before August 3, 2023. Processing of other batched disputes and dispute initiation remain temporarily suspended. Disputing parties should continue to engage in open negotiation.
Certified IDR entities will only be granted access to resume the federal IDR process for:
- Open single and bundled disputes from 2023
- Open single and bundled disputes from 2022
- Open single and bundled disputes where admin fees have been collected from both parties and updated in the portal prior to 8/3 OR if the payment deadline has expired prior to 8/3 and at least one party has paid
- Open previously determined eligible batched disputes where admin fees have been collected from both parties and updated in the portal prior to 8/3 OR if the payment deadline has expired prior to 8/3 and one party has paid
- Withdrawn or settled disputes where admin fees have been collected
- Any open disputes where the payment deadline has expired, and admin fees are set to ‘No’ for both parties
*Disputes that do not fall under these categories will not be accessible to the IDR entities.
In summary, with all that has been released to the entities – the following services are available:
- Status Updates – FHAS will only be able to give status updates for cases that we have access to in CMS.
- Sending New Links – FHAS will not be able to trigger new or old links for batched disputes – but all single 2022 and 2023 cases are accessible at this time.
- Determining Eligibility – FHAS will continue to accept additional documentation for all claim types that we request; however, we are unable to request your offer and payment for batched disputes at this time.
- Determinations – Determinations can be made on:
- Open single and bundled disputes from 2023
- Open single and bundled disputes from 2022
- Open single and bundled disputes where admin fees have been collected from both parties and updated in the portal prior to 8/3 OR if the payment deadline has expired prior to 8/3 and at least one party has paid
- Open previously determined eligible batched disputes where admin fees have been collected from both parties and updated in the portal prior to 8/3 OR if the payment deadline has expired prior to 8/3 and one party has paid
- Closing Disputes for Ineligibility – FHAS can still close a dispute for ineligibility IF we have access to the dispute.
- Withdrawals and Settlements – FHAS will continue to withdraw and settle disputes IF we have access to the dispute.
- Requesting Payment and Offer – FHAS will be requesting payment and offer for single or bundled disputes that we determine to be eligible.
Other updates of note include:
- At this time, certified IDR entities will be restricted from editing closed disputes, however, the entity can view them.
- The Departments also granted disputes in the Notice of Offer phase of the federal IDR process a blanket five business day extension to submit Notice of Offer webforms. The IT team is working to update due dates in the federal IDR portal; no additional actions required by the IDREs at this time.
- FHAS will not be accepting offers that are sent through email. CMS will notify parties when to submit their offers in the instance that the deadline fell within the portal outage. FHAS is not responsible for issuing links for due dates that landed on dates affected by the portal outage.

- CMS’ next intention is to open up the IDR portal to allow for submission of single and bundled disputes. This is still in progress at this time.
